TERM'S & CONDITION'S

The following Terms and Conditions apply for all orders placed with me, via this website or by any other means. By purchasing from me, you agree to be bound by these Terms and Conditions. If you do not agree with the Terms and Conditions, please do not purchase from me. I reserve the right to make amendments, or additions to these Terms and Conditions as I see necessary. These Terms and Conditions do not affect your Statutory Rights as a consumer.

1. INTERPRETATION

 

1.1. ‘You’/’Your’/’Yours’/'Recipient' – means you, the consumer, or user of this website

1.2. ‘Me’/'I'/'My'/'Sibling' – means me, Sarah Burke trading as (t/as) Sibling

1.3. ‘Website’ – means my website, www.siblingwares.com

1.4. ‘Goods’/’Products’/'Items' – means items made, and sold by me

2. WEBSITE TERMS OF USE

 

2.1. By using my website, you agree to comply with, and be bound by the following Terms and Conditions. If you do not agree with these Terms and Conditions, please do not use my website.

​3. INTELLECTUAL PROPERTY

 

3.1. These Terms and Conditions, and all other content displayed on this website, and on our social media outlets, including, but not limited to, images, descriptions, logo’s, video clips, is my property, and as such, is protected by the relevant Intellectual Property Laws, and other laws. You may not reproduce, modify, copy or distribute for commercial purposes unless you have received written permission from me. 

4. GOODS AND PRICING

 

4.1. Made to Order goods and Pre-Order goods are handmade to order, and as such, take time to make. Please allow 4-5 weeks for the making and delivery of 1 item, and longer for orders of 2 items of more. For orders placed which contain 2 or more items, recipients will be contacted with an estimated time-frame for the dispatching of their order. 

4.2. The responsibility to ensure the goods you purchase from me are suitable for you and the intended recipient, is passed to you.

4.3. The metals used to make each item are obtained and processed through a third party company who make all claims that the materials they supply are recycled, and do not include material from conflict areas or any newly mined material. These claims are accurate to the best of my knowledge. I can not be held responsible in the highly unlikely event that these claims are found to be inaccurate.

4.4. I can not be held responsible for any skin irritation you may experience caused by reactions to the metal used in my items. Each metal is clearly listed on each product page and it is your responsibility to select a metal option which is suitable for you and your skin type. If you have, or suspect, a metal allergy please get in touch prior to ordering.

4.5. The standard metals I offer my items in; Recycled Sterling Silver and Recycled 9ct Gold, can all tarnish with time and wear. Tarnishing occurs when copper reacts to moisture and air, and begins to oxidise. This is a natural process that will occur in jewellery with copper in it's alloy, and is not a defect or an indication of poor quality. By regularly wearing the jewellery, storing it in it's Sibling pouch, and washing with soap and water when necessary you can minimise tarnishing and slow down the tarnishing process. You should not use harsh chemicals or abrasion to remove the tarnish as this will damage the surface of the metal.

4.6. The sizing for each item is listed clearly on each item page. These sizes are accurate to the reasonable degree. It it your responsibility to ensure the size you order is appropriate for yourself, or the intended recipient.

4.7. For every order placed, a percentage of the profits made on that order will be allocated for a donation to a charity or cause. A single donation will be made each financial quarter, which will be an accumulation of these aforementioned allocated funds from each order placed in the previous quarter. The percentage allocated may vary from one quarter to the next, as it will be a decision weighed up on a number of factors. The percentage value to be donated each quarter is at my discretion. The charity or cause will change each quarter, and will be selected by me based on various factors such as the type of work they carry out, their reputation and trustworthy-ness, amongst others. I am not affiliated with any of these charities or causes, and I receive no financial gains for making these donations. As a soletrader I do not recieve any tax benefits for making these donations. I will disclose via my social media platforms which charity or cause has received the donation for that quarter, however in order to protect my business I will not disclose the value of the donation made, or the percentage value of the profits allocated. I reserve the right to end my 'Giving Back' approach at any time, and for any reason. 

4.8. To ensure my customers can be satisfied with my efforts to uphold any claims of the environmental impact of my practice on my website, through my social media platforms or other means, a Transparency document detailing the materials and processes I use can be obtained upon request.

4.9. All claims presented in my website and social media platforms pertaining to the materials, processes, and toward how I conduct my business are accurate to the best of my knowledge. 

4.10. The Journal section of this website is an area where I can go into more detail the reasons why certain decisions have been made for my business. These topics have been extensively researched, and the information I detail is accurate to the best of my knowledge. The information contained in this section of my website is for purely informative purposes, and I am not advertising or advocating the features included in these topics.  

4.11. All imagery of my products shown on my website and social media outlets are for illustrative purposes only. There may be some slight, reasonable variations from these images and the goods you receive, due to each item being handmade.

4.12. I make all reasonable efforts to ensure all descriptions of my goods are accurate.

4.13. Packaging and Branding Materials shown in any imagery may vary from the Packaging and Branding Materials you receive.

4.14. Once you have received the goods, responsibility is passed to you for the appropriate storage, wear and use of the goods. Recommendations are provided on the website. If the goods are not stored, worn or used in-line with recommendations, I am not liable for the loss in quality of the goods.

4.15. All prices shown on my website are inclusive of VAT. 

4.16. Prices for each item are not inclusive of postage and delivery. These additional costs will be applied at time of checkout where you will be given different delivery options with varying costs.

4.17. I reserve the right to change my pricing of goods at any time. If my prices change in the time between you placing an order, and the order being delivered, the price at the time you placed your order will be upheld.

4.18. I reserve the right to apply, change or remove Special Offers, or Sale items, as I see necessary.

4.19. In the event of a mistake in my pricing when I check your order, I will contact you via email to advise you of this error. You will then be given the option to purchase the goods at the correct price, or cancel your order. If I do not receive your response within 14 days, I will assume the order is cancelled, and will notify you by email.​

4.20. In the event that your order contains a combination of in-stock goods, and Pre-Order or Made To Order goods, the complete order will be shipped once the Pre-Order or Made To Order portion of the order has been fulfilled. This is to minimise shipping costs. If however you wish to receive the in-stock portion of your order before the Pre-Order or Made To Order portion is fulfilled, please get in touch so we can discuss shipment options.

5. ORDER AND PAYMENT

​5.1. I am not responsible for clarifying order details with you. If the order placed is incorrect, at your own error, you must contact me as soon as possible after your order has been placed, for the best chance of me being able to assist with the revision of your order at no additional cost. Changes incur costs with the Pre-Order and Made To Order goods. If your order is already being processed when you contact me to advise me of an error you have made when placing an order, I reserve the right to issue you with an invoice for any additional costs incurred in rectifying your order. The value requested in this invoice will be a fair representation of the costs I have outlaid and time spent on the original order, and any changes required in order to rectify the items to match your revised order. Early detection of errors in your order may be corrected at my own cost as a favour of goodwill, and this decision remains only at my discretion.

5.2. If, in the unlikely event, I fail to fulfill the order placed, please contact me and I will do my best to fulfil it accurately and quickly.

5.3. I must receive payment for your order in full, before I will begin to process your order and make the items. If there is a delay in your payment being received by me, I am not liable for the incurred delay of the goods being received by you.

5.4. Payment for your order will be accepted via SquareUp Europe LTD and Paypal, accepting all major UK issued card payments including Visa, MasterCard, Maestro, American Express, Visa Electron and Vpay, but excluding Discover, JCB and Union Pay.  

5.5. I reserve the right to reject, or cancel any orders, and will advise you via email if this has occured. In these unlikely circumstances, if your payment has already been taken, the account you used to place the order will be credited to the full amount.

6. ​DELIVERY AND POSTAGE METHODS

6.1. All Delivery charges will be applied at time of check-out. They are not included in the price of the goods. Delivery charges are as follows:

At this stage, I only deliver within the UK

Royal Mail Special Delivery for orders with a total of £500 or less - £7.65

Royal Mail Special Delivery for orders with a total between £500 and £1000 - £8.65

Royal Mail Special Delivery for orders with a total between £1000 and £2500 - £10.65

​6.2. From the point of your payment being received in full, orders of 1 item can take up to 4-5 weeks to fulfil. Orders of 2 items or more may take longer, and recipients will be contacted with an estimated time-frame for the dispatching of their order. Delivery time frame will vary depending on the delivery method you selected at the time of placing your order.

6.3. Delivery times may vary at busier periods, such as festive seasons, or should I be unable to produce the goods for a given time.​In these circumstances, you will be advised via email of the estimated time-frame for the dispatching of your order.

6.4. During busier periods, such as festive seasons, I will advise on the website the cut-off point for orders to be placed, to ensure you receive your goods in time. In these circumstances I will advise a recommended delivery method to be chosen at time of placing your order. If you select a different delivery method from the recommended method, at the time of placing your order, I am not liable for any delays to you receiving your order, and cannot guarantee you will receive them in time for the festive period.

6.5. An accurate delivery address must be provided at time of placing your order to avoid any unnecessary delays in the goods being dispatched. If you provide an inaccurate or incorrect delivery address, I am not liable for the goods not being delivered to you.

6.6. No refunds will be given in the event that an incorrect or inaccurate address has been supplied by you.

6.7. In the event you do not receive your order within 2 days of your order being dispatched, please contact me and I will investigate.

7. CANCELLATIONS, REFUNDS AND RETURNS

7.1. For goods which are Made To Order or Bespoke commissioned, in accordance with Consumer Contracts Regulations 2013, these are considered final sale and requests for a refund or return will not be granted unless specific circumstances are met.

7.2. For goods which are Pre-Order, please get in touch within 14 days of receiving your order if you wish to request to return your order for a full refund, or exchange your order for an item that is in-stock. Regrettably, I cannot offer to exchange your Pre-Order item for another Pre-Order item. I will be in touch to arrange for payment, by myself or yourself, to cover the difference in the price of the goods.

7.3. For goods that are in-stock, please get in touch if you wish to request to return your order for a full refund, or exchange your order for something else in the shop, within 14 days of receiving your order. This does not apply for earrings (see 7.4). If an exchange is requested, for any item that is in-stock I will be in touch to arrange for payment, by myself or yourself, to cover the difference in the price of the goods. If you request a Pre-Order or Made To Order item for your exchange, please be aware it can take 4-5 weeks to fulfil your order, and I will be in touch to arrange for payment, by myself or yourself, to cover the difference in the price of the goods.

7.4. For hygiene reasons, all earrings are non-refundable and cannot be returned or exchanged. 

7.5. If you wish to request a refund, or to return an item, you must contact me within 14 days of receiving your order to let me know of your wish to return/recieve a refund for an item, and your reasoning why. I will then fully review your order, any issues you may be experiencing and advise what I can do to support your request, or correct any issues. Under any circumstances, you must not send me your item/s before you have received a reply from me. If, for whatever reason, you send the item back to me before you have received my response to your request, I do not guarantee you will receive a refund.

7.6. For Pre-Order and Made To Order goods, if you wish to cancel your order before the goods have been dispatched, you must contact me as early as possible, as it is not guaranteed that I can issue a refund. If your order is already being processed when you contact me to advise me you wish to cancel, depending on the stage of the process that your order is in, I reserve the right to issue either a partial or full refund, or no refund if your order is nearing completion. This decision remains at my discretion. The value I offer as refund will be a fair representation of the costs I have outlaid and time spent on the order. If you contact me to cancel your order, I will respond to let you know the outcome of the value you will be offered as refund. At this point, I will stop processing your order until I have confirmation of your decision.

7.7. If you are dissatisfied with the goods you receive from me, or if you believe the order you have received from me to be incorrect, please contact me as quickly as possible so I can investigate the matter, and do my best to rectify it. 

7.8. I will accept returned items if it is proven that I have inaccurately fulfilled your order from the details you provided at the time of ordering. Under these circumstances, the goods can be returned to me for a full refund. The goods must be returned in their original packaging, and securely packaged to ensure no damages can be incurred to the items. No refunds will be issued until the goods have been returned to me and I have received them, and reviewed them to my satisfaction. This may take 3-4 days. If when I receive the goods they arrive damaged, and I deem them to have been poorly packaged, it is not guaranteed that you will be granted a refund. This decision remains at my discretion. If I am satisfied that the goods have been adequately packaged, I will issue a full refund and you will be contacted to advise you of this.

7.9. For Made To Order goods, I will not accept requests for a refund or return based on reasoning, including, but not limited to:

  • You/the recipient decide you no longer like or want the item

  • The item doesnt fit; it is your responsibility to ensure the size you order is suitable

  • You/the recipient experience skin irritation/allergies/green discoloration due to wear of the item. It is your responsibility to ensure you order the item in a metal which does not irritate your skin. Green discolouration is a natural reaction some people's skin have to copper, which can be found in many alloyed metals, including my items.

  • The item is not what you/the recipient was expecting. The descriptions and imagery on this website and my social media platforms should sufficiently provide indication of what to expect. If you have any queries, or if there is anything you are unsure of, please contact me before ordering. 

7.10. A re-stocking fee will apply if your goods are returned to me not in the original packaging.

8. COMMUNICATION

8.1. All communication you receive from me shall be in accordance with GDPR and my privacy policy

8.2. You shall receive communication from me via email on two occasions (unless 8.3. or 8.4. are applicable) upon your order being placed. The first shall be to advise you that your order has been received and will be processed accordingly. The second will be when your order is complete and has been dispatched to you. If you need to contact me after you have placed your order you should do so via email as quickly as possible. In these circumstances, I shall respond to you via email, in accordance with GDPR and my privacy policy.

8.3. In busier periods, or if you order more than one item, I will contact you to advise the estimated time frame for the dispatching of your order. This shall be done via email, in accordance with GDPR and my privacy policy.

8.4. If I need to contact you to confirm any details regarding your order I shall do so via email. Please respond as speedily as is possible to ensure this does not impede on the processing of your order. I may put the processing of your order on hold until I have received your response. In these circumstances, if your response is delayed, I cannot be held responsible for a delay in the dispatch of your order.

8.5. Any communications received by me, from you, via this website, my social media outlets, or any other means, if deemed abusive or offensive will result in you being blocked from making any purchases from me, via my website, or any other means, and depending on the nature of the of the communication, further action may be taken.

8.6. If you wish to contact me, please use one of the following 2 communication methods:

All other means of communication may not be monitored regularly so should be avoided.

8.7. Any communication you send me regarding your order must contain the order reference number you will receive in your confirmation email, to ensure accuracy of processing your enquiry. Failure to do so may lead to errors in processing your enquiry.
